Shane Sutter is the main antagonist of the Law & Order episode "Performance". He is a teenager who rapes a female classmate as part of a competition with his friends in which they score a point for every sexual conquest.
He was portrayed by Peter Facinelli, who also portrayed Takmet in The Scorpion King.
Overview[]
Shane is a popular high school student from a wealthy family and the leader of a clique of boys who call themselves "The Mack Rangers". He and the other "Rangers" pride themselves on their sexual prowess, competing with each other to see who can sleep with the most female classmates, each of whom is worth a "point" in their game.
Most of their conquests have sex with them willingly, but the boys also intimidate girls into giving them what they want by threatening to ruin their reputations and social lives if they say no. They spread rumors about one such girl that she contracted AIDS after having sex with her brother, resulting in her being bullied so severely that she transfers to another school.
One day, Shane and his best friend and fellow Mack Ranger Kyle Winters invite classmate Corey Russell over to Shane's house, where Shane tries to seduce her. She consents at first, but she says no when Kyle starts filming them. Shane then overpowers and rapes her while Kyle records the assault. After he is done with her, he shoves a pillow in her face and fires a fake pistol into it to make it look like he killed her. Kyle then sells the tape to a pornographic video store for $500.
In "Performance"[]
A man who rented the tape for a bachelor party is worried that it is a snuff film, so he turns it over to NYPD Homicide Detectives Lennie Briscoe and Mike Logan, who eventually identify Corey as the victim from a tattoo on her arm. They go to the Russell home expecting to give her parents the bad news about Corey's death, only to find Corey herself, traumatized but alive. She identifies Shane as the boy in the tape, so they bring him in to their precinct for questioning. He claims that Corey consented to have sex with him, and that the fake gun was "a goof". Corey tells Lieutenant Anita Van Buren that Shane forced himself on her, however, so Briscoe and Logan arrest him for first-degree rape.
Executive Assistant District Attorney Jack McCoy and Assistant District Attorney Claire Kincaid investigate Corey's accusation and find out about the Mack Rangers and their points-for-sex game; they also find out that the boys sexually assaulted several other girls who declined to press charges. McCoy calls one of these girls as a witness during the trial, where she describes how Shane and the other Mack Rangers sexually assaulted her in the school gym's swimming pool. Corey testifies that she only went to Shane's house because she feared being ostracized if she didn't. McCoy then plays the tape, horrifying everyone in the courtroom, including Shane's parents. Shane, meanwhile, testifies in his own defense that the tape and the gun had been Corey's idea, and that her cries of fear and pain were an act.
The jury finds Shane and Kyle guilty of rape, but their lawyer appeals the verdict on First Amendment grounds, arguing that testimony about the Mack Rangers' points-for-sex competition violated their right to free association. The appeals court overturns the guilty verdict, giving Shane and Kyle the right to a new trial, this time excluding evidence of the competition. Undeterred, McCoy and Kincaid charge every member of the Mack Rangers with conspiracy to commit rape in hopes that the other boys will testify against Shane to stay out of prison.
Sure enough, one of the Rangers, Ethan Quinn, admits that Shane bragged about raping Corey. McCoy meets with Shane, his lawyer, and his parents, offering a plea bargain in which Shane would serve two years in prison. Shane once again insists that Corey wanted to have sex with him, and only got "cold feet" at the last minute. When McCoy presses him, however, Shane grudgingly admits that he raped her. Shane is then sentenced to two years in prison, while Kyle is sentenced to 18 months.
